It is a HUD-1, also called a HUD. HUD is the Federal Agency, the Department of Housing &amp;amp; Urban Development, also called HUD. &lt;/p&gt;&lt;p&gt;A HUD-1 is a document regulated by HUD. It is the financial accounting for a real estate sale. &lt;strong&gt;Here is why it is important to a short sale. &lt;/strong&gt;&lt;/p&gt;&lt;p&gt;Before a short sale lender will accept a short sale, they want to know what they will net from the sale.&lt;strong&gt; &lt;/strong&gt;A HUD-1 breaks down all the projected closing costs so the lender can see their net. &lt;/p&gt;&lt;p&gt;Most agents are familiar with a HUD-1. They see them at the closing of every home they sell. &lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;But, seeing a HUD-1 at a closing is not the same as the familiarity you learn on short sales.&lt;/strong&gt; &lt;/p&gt;&lt;p&gt;See, if you mess up on that HUD-1, then it puts the short sale transaction in jeopardy. The short sale lender will look at a projected HUD-1 and agree to accept a certain number. If unexpected costs get added to the HUD-1, then that net goes down. (There are always unexpected costs on a short sale. I can tell you from personal experience.) &lt;/p&gt;&lt;p&gt;Now, the agent has to go back and re-negotiate with the short sale lender. &lt;strong&gt;That can drag out the process another 60-90 days. &lt;/strong&gt;The buyer will usually get frustrated and cancel the contract. Then, the agent has to re-sell the house and start the process all over again. &lt;/p&gt;&lt;p&gt;&lt;strong&gt;This is what causes many agents to hate short sales.&lt;/strong&gt; They didn&amp;rsquo;t take the HUD-1 seriously and had problems on a short sale. As a result, they think all short sales are impossible. &lt;/p&gt;&lt;p&gt;To truly be successful at short sales, the agent must understand HUD-1s inside and out. They need to make sure that every single projected expense is added to the HUD-1 at the beginning of the negotiations. Adding them after you have negotiated isn&amp;rsquo;t going to work. &lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;&lt;p&gt;Thinking about a short sale? Why?&lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;&lt;p&gt;&amp;nbsp;Because they don&amp;#39;t understand them. &lt;/p&gt;&lt;p&gt;So, don&amp;#39;t believe them when they tell you that short sales are impossible. &lt;/p&gt;&lt;p&gt;I will explain what causes their problems in today&amp;#39;s post. &lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;&lt;p&gt;There are two things you must understand if you are doing short sales. They are BPOs and HUD-1s. &lt;/p&gt;&lt;p&gt;A BPO is what the short sale lender uses to determine the value of the property. &lt;/p&gt;&lt;p&gt;&lt;strong&gt;B&lt;/strong&gt;&lt;strong&gt;PO stands for &amp;quot;Broker&amp;#39;s Price Opinion.&amp;quot; &lt;/strong&gt;&lt;/p&gt;&lt;p&gt;They are what another real estate agent (Broker) thinks a property is worth. Basically the agent gives their opinion of the value of the property. &amp;quot;I think it is worth 300k&amp;quot;, they put on the report. &lt;/p&gt;&lt;p&gt;Lenders accept or reject short sale offers based on the BPO value. If the agent has given a value of 300k, then a short sale lender will not accept a sales price of 250k. &lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;&lt;p&gt;The problem is that, in my opinion, sometimes the values are inaccurate. I have seen agents drive 50 miles away to evaluate a property. They go to a place where they do not sell real estate. As a result they are not familiar with the local marketplace. &lt;/p&gt;&lt;p&gt;Because of this I always try to meet the agent doing the BPO at the property. I explain the market value to them and tell them what is happening with the property. I explain exactly why the property is selling for the sale price. I tell them what buyers have said about the property and why it isn&amp;#39;t selling for a higher price. &lt;/p&gt;&lt;p&gt;This helps them to give an accurate value. And they can&amp;#39;t understand when the seller isn&amp;#39;t excited by their lowball offer. &lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;&lt;p&gt;Here is an example of a recent story where this happened. A buyer makes an offer on a short sale. &lt;/p&gt;&lt;p&gt;&amp;nbsp;1. The buyer puts no money in deposit for the home. &lt;strong&gt;In other words, they have about zero risk. &lt;/strong&gt;(Meanwhile, the seller is still risking foreclosure.) &lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;&lt;p&gt;2. They are putting $150,000 down on the property, but won&amp;#39;t bother putting any more than $1,000 in escrow and only after the short sale is approved. &lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;3. They are only allowing 30 days for short sale approval.&lt;/strong&gt; (News flash: Most short sales take an absolute minimum of 60 days to be approved.) &lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;4. They are demanding the seller take the property off the market&lt;/strong&gt; and not accept backup offers. &lt;strong&gt;I&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;s this a little one sided or what? &lt;/strong&gt;&lt;/p&gt;&lt;p&gt;If you are a short sale seller, then they agent representing you should ask for a better offer. You need the buyer to have a little skin in the game. You should only accept and work with one offer at a time.&lt;/strong&gt; If you accept more than one offer at a time, then buyers get mad. The primary offer might get angry because you accepted a backup offer. In addition, multiple offers confuse everyone involved including the short sale lender. &lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;2. You should make sure the buyer can get financed for a loan.&lt;/strong&gt; That means the buyer should give you genuine proof of that, whether a pre-approval or pre-qualification. &lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;3. We recommend that the buyer inspect the home before the sales contract is signed.&lt;/strong&gt; If any unexpected problems come up (and they do), then you can adjust the offer price that is submitted to the short sale lender. This saves from having to negotiate the price again if a problem is found after the short sale is approved. Besides, the lender is more likely to accept a lower price if you send them a copy of the inspection. &lt;strong&gt;&amp;nbsp;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;4. The buyer agrees to wait the necessary 60-90 days for an answer on the short sale.&lt;/strong&gt; That time will depend on the lender. Some lenders are fast and some are slow. &lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;5. The buyer should put a reasonable deposit in escrow&lt;/strong&gt; to keep them on board for the necessary time required for the short sale to be approved. These are what we have determined to be necessary for a successful short sale. If you don&amp;#39;t have a serious buyer then you are wasting your time and your agent&amp;#39;s time as well. Many buyers and their agents think that since a property is a short sale, then offers can be treated very casually. This only hurts the home sellers trying to avoid foreclosure when the buyers can&amp;#39;t get a loan or back out after the inspection. Helping someone avoid foreclosure is serious business. BPO stands for Broker&amp;#39;s Price Opinion. &lt;/p&gt;&lt;p&gt;A Broker&amp;#39;s Price Opinion is when a licensed real estate agent gives their opinion of the value of a property. That value is what the lenders use to process the short sale. &lt;/p&gt;&lt;p&gt;Most short sale approvals or denials are based off of that opinion of value. The agent goes thru all the recent sales of properties similar to the property they are valuating. They want to find the 3 closest comparable sales.&amp;nbsp;&amp;nbsp;&lt;/p&gt;&lt;p&gt;The more recent a sale is then the closer of a comparable it is considered to be. The same goes for properties that are close geographically (in the same neighborhood is preferred) and close in size and number of bedrooms or baths. Most agents are not appraisers. Because an appraiser&amp;#39;s license is required to appraiser properties they give their opinion of the value.&lt;/p&gt;&lt;p&gt;&amp;nbsp;Now, I&amp;#39;m sure you are wondering, &amp;quot; Why do the lenders use these rather than an appraisal?&amp;quot; &lt;/p&gt;&lt;p&gt;&lt;strong&gt;Here is why.&lt;/strong&gt; Many people think they are more accurate of a valuation than an appraisal. Agents are more in tune with exactly what a property can sell for. After all, whatever opinion of value they put for a property is usually supposed to be backed up later by a sale for that price. That causes agents to be more accurate with their valuations. I just don&amp;rsquo;t want to be upside down and want a fair interest rate. Why should I pay on a mortgage that is twice as much as my home is worth, plus the interest on that mortgage? It just doesn&amp;rsquo;t make sense. How can I get a loan mod with a fair interest rate where I am repaying what my home is worth today? Thank for your help, Luis.&amp;rdquo; &lt;/p&gt;&lt;p&gt;&lt;strong&gt;Here was our answer.&lt;/strong&gt; You are asking for something that most lenders don&amp;rsquo;t like to do. Lenders don&amp;rsquo;t like principal reductions.&lt;/p&gt;&lt;p&gt;Here is why. Principal reductions usually have to be written down right away on their financial books. If you owe them $300,000 and they reduce your loan principal to $150,000, then they immediately have to reduce the company&amp;rsquo;s earnings by $150,000 for the year. If they do that on enough loans, then it hurts the CEO&amp;rsquo;s ability to get a bonus. He may even risk losing his job. I don&amp;rsquo;t offer much sympathy to CEOs, but that&amp;rsquo;s how it works. &lt;/p&gt;&lt;p&gt;Here is what lenders like to do instead. Example: They will reduce your interest rate to 2% for 5 years. After that, the interest rate will go back to the original level. That way the write off will be much smaller than $150,000. It might be a $30,000 write off. That makes a much smaller difference on the CEO&amp;rsquo;s bonus for the year. &lt;/p&gt;&lt;p&gt;It&amp;rsquo;s also one of the reasons that most loan mod programs don&amp;rsquo;t work. The banks aren&amp;rsquo;t willing to be realistic. &lt;/p&gt;&lt;p&gt;It&amp;rsquo;s also why I think a short sale is the best principal reduction plan. You get to erase the bad debt. Rent a home for 2-3 years and then buy a new one at today&amp;rsquo;s market level. That way you guarantee your principal reduction and don&amp;rsquo;t waste time arguing for a principal reduction with someone who isn&amp;rsquo;t allowed to give it to you. &lt;/p&gt;&lt;p&gt;Thinking about a short sale? What is your exact service and what are the fees involved? I do not have any cash in savings and pretty much live paycheck to paycheck. Tawny.&amp;quot; &lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;&lt;p&gt;&lt;em&gt;&lt;strong&gt;Here is the answer to Tawny&amp;#39;s Question:&lt;/strong&gt; A Short Sale doesn&amp;#39;t cost the homeowner any money. All of the costs are paid for by the homeowner&amp;#39;s lender. &lt;/em&gt;&lt;em&gt;Now, I&amp;#39;m sure you are asking, &amp;quot;The bank is losing money on the short sale. They wouldn&amp;#39;t want to have to pay to sell the property.&amp;quot; &lt;/em&gt;&lt;em&gt;Many people also think this. After all, it makes sense logically. But, it&amp;#39;s actually not the case. &lt;/em&gt;&lt;em&gt;Banks have been lending money for centuries. They have learned from past experience that a short sale is a good way to cut their losses. &lt;/em&gt;&lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;em&gt;In fact, a recent study by the Boston Consulting Group actually showed that a short sale reduced a lender&amp;#39;s losses by 20%, compared to a foreclosure. &lt;/em&gt;&lt;/strong&gt;&lt;em&gt;After a lender forecloses on a property they put it up for sale. They have to hire and pay a real estate agent and all the other related costs. &lt;/em&gt;&lt;em&gt;Why not pay those costs on a short sale and cut their losses by 20%? It&amp;#39;s a good business decision. I am concerned that they might do that when I finally sell the property and I&amp;rsquo;ll never get the short sale approved.&amp;rdquo; &lt;/p&gt;&lt;p&gt;&amp;nbsp;Here was our answer. &lt;/p&gt;&lt;p&gt;Most lenders will not talk to you about a short sale until you have several things in place. They want a solid offer from a pre-qualified home buyer along with all the necessary financial documents. &lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;&lt;p&gt;Why do they do this? Because they only want to process short sales that will sell and close. Now, I think it&amp;rsquo;s a stupid way to do things. Instead of refusing to negotiate short sales until there is an offer on the table, they should instead pre-approve short sales. It would make the process so much easier. A home could be placed on the market at a set price. Buyers would be more interested in the property because they know they can get an answer in 2-3 days versus 2-3 months. &lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;&lt;p&gt;We have brought this up with Matt Vernon, the Vice President of Bank of America&amp;rsquo;s Short Sale Department. He knows there is stuff to improve. But, it&amp;rsquo;s hard to change the course of a huge company with so many different parties involved. &lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;&lt;p&gt;Despite all this, experienced short sale agents are getting short sales approved every day. The Short Sale Process is getting better and easier to navigate. More and more lenders are moving towards &amp;ldquo;Approved&amp;rdquo; Short Sales. &lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;&lt;p&gt;You just need to find a good short sale realtor that can navigate their way thru the crazy short sale process. &lt;/p&gt;&lt;p&gt;Thinking about a short sale? Your agent will show them that they are better off accepting the short sale. &lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;&lt;p&gt;If you have presented your case well and the lender buys it, then they will usually waive the deficiency or promissory note and accept what they can get. After all, something is better than nothing. Make sense? &lt;strong&gt;&amp;nbsp;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;&lt;/strong&gt;&lt;/p&gt;&lt;p&gt;&lt;strong&gt;Another option is to hire a good lawyer to negotiate for you. &lt;/strong&gt;Look for a lawyer with experience in bankruptcy. They can use the threat of bankruptcy to convince the lender to approve the short sale with the deficiency waived. &lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;&lt;p&gt;Bankruptcy is very bad for creditors. If you declare bankruptcy, then it could take 12-18 months before the lender can sell the house. Their right to collect from you would be wiped out in bankruptcy.&lt;/p&gt;&lt;p&gt;&amp;nbsp;&lt;/p&gt;&lt;p&gt;&amp;nbsp;A short sale where they get their money today is a much better option.
